1. Introduction
Greetings from CentralReferenceHub ("we," "us," or "our"). These Terms & Conditions ("Terms") are applicable to your usage of our yacht charter services and the website provided at centralreferencehub.xyz (the "Service"), maintained by CentralReferenceHub.
By reserving a charter or utilizing our Service, you consent to comply with these Terms. Should you object to any part of these terms, you are prohibited from using the Service.
2. Service Overview
CentralReferenceHub offers an array of upscale yacht charter services, inclusive of:
- Yacht rentals for the day
- Evening sails
- Corporate getaways
- Exclusive gatherings
- Extended charters
Availability of services is contingent on various factors including but not limited to weather conditions. We retain the prerogative to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a successful charter reservation, one must:
- Have attained at least 18 years of age
- Supply truthful and comprehensive information
- Remit the deposit amount as indicated in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A confirmed booking is established with the payment received and our formal written confirmation. We have the prerogative to decline service at our sole discretion.
3.3 Availability
Scheduled charters depend on the availability of the vessel and suitable climatic conditions. We will endeavor to meet your requested dates and timings.
4. Payment Terms
4.1 Pricing
The prices provided are in € and include all applicable taxes, unless stated otherwise. Price adjustments may be made and could happen without prior notification.
4.2 Payment Schedule
- Deposit: A payment of 50% of the total cost for the charter is required at the time of reservation
- Balance: The remaining balance must be paid 48 hours in advance of the charter's departure
- Additional fees (if applicable): Payable upon the charter's conclusion
4.3 Payment Methods
We process payments via major credit cards, bank wire transfers, and certified checks using secure and encrypted transaction systems.
5. Termination and Reimbursement Guidelines
5.1 Withdrawals by the Client
- If cancelled more than 72 hours prior to leaving: Refund in full except for service charges
- Cancellation between 24 and 72 hours before departure results in a refund of half the price
- Cancelling less than 24 hours before taking off: No reimbursement offered
5.2 Scrapped Trips Due to Weather
Should the weather create hazardous conditions as determined by our skipper, guests will be given the choice to:
- Move their booking to an alternate available slot without extra charges
- Receive a complete refund if rebooking is unfeasible
5.3 Failures of a Technical Nature
Should there be a mechanical failure with the designated boat, we will aim to arrange a comparable substitute. When substitution isn't an option, clients will get a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Adhere to instructions given by the crew
- Utilize safety gear when it's needed
- Inform about any health issues that could impact their well-being
- Stay within the boundaries set for passengers on the ship
6.2 Prohibited Items
Items not allowed on the ship include:
- Containers made of glass
- Banned substances
- Weapons or any form of firearms
- Over-indulgence in beverages (more than what is considered moderate)
- Animals (except if given permission beforehand)
6.3 Conduct
Passengers are expected to behave in a manner that is considerate to others. Should a passenger's conduct create a risk to safety or interrupt the enjoyment of others, we maintain the authority to end the service prematurely without offering a refund.
7. Responsibility and Protection
7.1 Our Responsibility
The extent of our responsibility is confined to the sum paid for your charter. We are not liable for:
- Injuries to persons caused by their own carelessness
- The loss or damage of personal belongings
- Secondary, incidental, or penal damages
- Holdups due to weather or events outside our purview
7.2 Protection Policy
We possess extensive marine insurance to cover our fleet and operations. Passengers should ensure they have their own travel and personal insurance.
7.3 Acknowledgement of Risk
By opting to use our charter services, you recognize that marine undertakings come with inherent dangers, and you take on the responsibility for ensuring your own safety and security.
8. Modifications and Itinerary Changes
Our organization retains the discretion to alter travel plans, paths, or timetables as necessitated by weather events, safety prerequisites, or logistical needs. We shall endeavor to arrange suitable substitute activities.
9. Force Majeure
Our company bears no responsibility for any postponements, annulments, or changes in travel caused by circumstances outside of our influence, which include but are not limited to:
- Extensive weather conditions
- Catastrophic events of nature
- Statutory enactments
- Docking facility shutdowns
- Breakdowns of machinery
10. Privacy and Data Protection
We treat your private data according to our Privacy Policy. Utilizing our services implies agreement to our data collection and usage as outlined in the Privacy Policy.
11. Intellectual Property
The material found on our website, like texts, visuals, insignias, and pictures, falls under copyright and intellectual property laws. Unauthorized copying, distribution, or making derivatives is not allowed without express written consent from us.
12. Governing Law
The legal framework for these Terms is the law enforced in Germany. Disputes, if any, will be settled in the judicial courts of Hamburg, Germany.
